Ohio Workers Compensation Laws

What is an injury under workers compensation law?

You are likely eligible for workers compensation benefits if you suffered an injury while you were on your employer’s premises or if working on behalf of your employer in an off-site location. Unlike in a personal injury claim, you are not required to prove your employer’s negligence caused your injury, but you must show that an injury occurred at your workplace or during the course of employment.

The law firm of Weisser & Wolf was established in 1988 to protect workers’ rights to compensation for injuries and illnesses. Our dedicated team includes knowledgeable lawyers with extensive experience in filing claims with the Industrial Commission of Ohio and the Ohio Bureau of Workers’ Compensation. Two of our attorneys are Ohio State Bar Association certified specialists in workers compensation. We assertively pursue your maximum recovery through settlement or trial.

Types of injuries that qualify you for workers comp

You are not expected to carry the financial burden of your workplace injuries alone. Occupational Safety and Health Administration (OSHA) and Ohio law mandate that all employers maintain workers compensation insurance to pay claims for job-related injuries, including for:

  • Herniated disc in back or neck
  • Head injuries
  • Concussions
  • Closed-head injuries
  • Amputation injuries
  • Crush injuries to hands and feet
  • Knee injuries
  • Torn ligaments
  • Meniscus tears

You are eligible to recover for lost income, diminished wages, medical bills, long-term care expenses for temporary or permanent disability, and in some cases, even punitive damages for your injuries. If your employer violated safety standards you may be entitled to additional compensation for a Violation of Specific Safety Requirements (VSSR) claim.

Protection for your mind and body

Although most workers compensation claims are filed for physical injuries, the laws also protect mental health. If your on-the-job injury leads to mental issues — such as Post-Traumatic Stress Disorder (PTSD) or depression — you have a right to treatment and compensation.
